# Policy & Compliance

ScaleConnect operates within the Australian financial services regulatory environment. The platform is designed to support brokers in meeting their obligations — not replace them.

## Regulatory Landscape

| Legislation | How ScaleConnect supports it |
| ------------------------- | ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- |
| **Privacy Act 1988** | Data collection, storage, and access controls comply with the Australian Privacy Principles (APPs). Role-based access ensures client data is only visible to authorised users. See [Data & Privacy](https://github.com/scaleapp-au/scaleconnect-docs/blob/main/trust-centre/data-and-privacy.md). |
| **Corporations Act 2001** | ScaleConnect is a technology platform, not a financial services provider. Brokers hold their own AFSL or ACL. The platform provides modelling tools — not advice. |
| **NCCP Act** | The simulation engine supports brokers' best-interest obligations by providing data-driven projections. Brokers use these to inform (not replace) their professional judgment. |
| **AML/CTF Act** | Client identity data captured in the platform supports brokers' record-keeping obligations. See the AML/CTF section below for details. |

## Platform Boundaries

ScaleConnect Pty Ltd (ACN 690 604 427) does not provide any credit assistance, financial product advice, or other financial service, and does not hold an Australian Financial Services Licence or Australian Credit Licence.

ScaleConnect provides financial modelling and simulation tools. It does not:

* Provide financial advice, credit advice, or investment recommendations
* Replace a broker's professional judgment or regulatory obligations
* Monitor or enforce compliance on behalf of brokers
* Act as an AML/CTF reporting entity
* Provide legal, property, taxation, or accounting advice

Brokers are responsible for their own regulatory compliance, licensing, and the advice they provide to clients. For full disclaimers, see [Limitations & Disclaimers](/scaleconnect-docs/trust-centre/limitations-and-disclaimers.md).

## AML/CTF (Anti-Money Laundering and Counter-Terrorism Financing)

Mortgage brokers in Australia are reporting entities under the AML/CTF Act 2006. This means you are required to identify and verify your clients, monitor for suspicious activity, and maintain records.

ScaleConnect is not an AML/CTF reporting entity and does not perform customer due diligence on your behalf. However, the platform captures and stores client identity data that supports your record-keeping obligations:

| Data captured in ScaleConnect | How it supports AML/CTF |
| -------------------------------------- | -------------------------------------------------- |
| Full name, date of birth, email, phone | Supports customer identification procedures |
| Citizenship and residency status | Supports identity verification context |
| Client profile and financial data | Supports ongoing customer due diligence records |
| Strategy history and audit trail | Supports record-keeping of advice and interactions |
| Data export (Excel, API) | Supports extraction for compliance reporting |

{% hint style="warning" %}
ScaleConnect does not verify client identity documents, screen against sanctions lists, or file suspicious matter reports. These are your obligations as a reporting entity. If you need guidance on your AML/CTF program, consult your compliance officer or AUSTRAC.
{% endhint %}

## NCCP Act (National Consumer Credit Protection)

The NCCP Act requires brokers to act in the best interests of their clients and to maintain records of the advice and assessments they provide. ScaleConnect supports this by:

* Producing data-driven projections that document the basis for financial discussions
* Maintaining a full history of strategies, events, and assumptions for each client
* Generating AI Reviews that provide a documented assessment of each client's position
* Storing client notes and meeting transcripts as part of the client record

## Querying This Documentation
If you need additional information that is not directly available in this page, you can query the documentation by asking a question.

Perform an HTTP GET request on the following URL with the `ask` and `goal` query parameters:

```
GET https://docs.scaleconnect.com.au/scaleconnect-docs/trust-centre/policy-and-compliance.md?ask=<question>&goal=<user_goal>
```

`ask` is the immediate question: it should be specific, self-contained, and written in natural language.
`goal` is what the user is ultimately trying to achieve, the reason they need the answer. Sharing it helps GitBook give you a better, more relevant answer. A goal is most helpful when it describes the outcome the user wants rather than restating the question. For example, with `ask=how do I create an API token`, a goal like `automate deployments from our CI pipeline` lets GitBook tailor the answer to that use case.

The response will contain a direct answer to the question and relevant excerpts and sources from the documentation.

Use this mechanism when the answer is not explicitly present in the current page, you need clarification or additional context, or you want to retrieve related documentation sections.
